Terms of Use

These Terms of Use are an agreement between the User and the Province and govern the User’s use of the website.   By clicking the button to indicate that the User accepts these Terms of Use, and in consideration of the use of the website, the User agrees to the terms and conditions set out below.  The User may be required to accept additional terms and conditions in order to use a particular Service.  If the User is under 19, the User must obtain the consent of the User’s parent or guardian to accept these Terms of Use on the User’s behalf, in which case the User’s parent or guardian is responsible for the User’s use of the website.

Personal Information Collection Notice

1.         Certain types of information are automatically collected from the User, in accordance with the Province’s Privacy Policy, as a result of the use of the website.

2.         The User's information is collected by the Province pursuant to section 26(c) of the Freedom of Information and Protection of Privacy Act (British Columbia) for the purpose of allowing the User to make a payment through the Revenue Services of British Columbia (RSBC) Billing & Payment Services website. Acceptable Use

3.         The User must not use the website in any way that would jeopardize the security, integrity and/or availability of the website.  Without limiting the general nature of the foregoing sentence, the User must not:

  • use the website for any unlawful or inappropriate purpose;
  • tamper with any portion of the website;
  • input or upload to the website any information which contains viruses, Trojan horses, worms, time bombs or other computer programming routines that may damage or interfere with the performance or function of the website;
  • use the website to conduct hacking and/or intrusion activities;
  • attempt to circumvent or subvert any security measure associated with the website;
  • attempt to collect any information about other Users of the website or take any action that might reasonably be construed as likely to adversely affect other Users of the website; or
  • remove or alter any proprietary symbol or notice, including any copyright notice, trade-mark or logo displayed in connection with the website and/or Services.

Changes to Website and/or Terms of Use

4.         The Province reserves the right at any time, in its sole discretion and without prior notice to

Users, to do any or all of the following:

  • make changes to the website;
  • deny the User access to the website; 
  • discontinue the website or any Service; and
  • make changes to these Terms of Use. 

5.         By continuing to access and/or use the website, the User will be conclusively deemed to have accepted any changes to these Terms of Use.

Termination

6.         The User’s rights to use the website or any Service will terminate automatically:  (a) if the Province chooses to discontinue the website or Service, in its sole discretion, for any reason; or (b) if a User fails to comply with any provision of these Terms of Use.  Upon termination, the User must immediately cease all use of the website or Service.

Limitation of Liability and Disclaimer

7.         In addition to the Province’s general Limitations of Liabilities, you agree that to the maximum extent permitted by applicable law, under no circumstances will the Province be liable to any individual or entity for any direct, indirect, special, incidental, consequential or other loss, claim, injury or damage, whether foreseeable or unforeseeable (including without limitation claims for damages for loss of profits or business opportunities, use of or inability to use the website or any Service, interruptions, deletion or corruption of files, loss of programs or information, errors, defects or delays) arising out of or in any way connected with a User’s use of the website or any Service and whether based on contract, tort, strict liability or any other legal theory.

8.         The website is provided “as is”.  The User’s use of the website is entirely at the User’s own risk. 

In addition to the Province’s general Warranty Disclaimer, the Province makes no representations or warranties that: 

  • the User’s use of the website will be timely, uninterrupted or error free;
  • any errors in the website will be corrected; or
  • the website will meet Users’ expectations and requirements.

General

9.         These Terms of Use (and any hyperlinked terms referred to in these Terms of Use) constitute the entire agreement between the User and the Province with respect to the subject matter of these Terms of Use, and supersede and replace any prior oral and/or written agreements.

10.       The headings in these Terms of Use are inserted for convenience only, and will not be used in interpreting or construing any provision of these Terms of Use.  In these Terms of Use:  (a) words expressed in the singular include the plural and vice versa, unless the context otherwise requires; and (b) “includes” and “including” are not intended to be limiting.

11.       If any provision of these Terms of Use is invalid, illegal or unenforceable, that provision will be severed from these Terms of Use and all other provisions will remain in full force and effect. 

12.       These Terms of Use will be governed by and construed in accordance with the laws of British Columbia and the laws of Canada applicable in British Columbia.  By using the website, the User consents to the exclusive jurisdiction and venue of the courts of British Columbia for the hearing of any dispute arising from or related to these Terms of Use and/or the User’s use of the website.

Definitions

13.       In addition to any terms defined elsewhere in these Terms of Use, the following terms have the following meanings:

  • Website” means, collectively, the Site and the Services.
  • Province” means Her Majesty the Queen in Right of the Province of British Columbia, as represented by the Minister of Finance.
  •  “Service or Services” means the services accessible to Users through the website, including payments, account information, subscriptions, notifications, forms distribution and submission and invoicing.
  • Site” means the Revenue Services of BC Billing & Payment Services website, which provides Users with secure, consolidated access to the Services.
  • User” means an individual who registers with a unique Login ID and is granted access to the website and, in the case of an individual who is under the age of 19, includes the individual’s parent or guardian.
  • Login ID” means a unique identification (email address), which represents each and every identification number or credential assigned or approved by the Province and permits the User to access the website.
  • User’s Information” means personal information collected from the User by the Province for the purpose of providing the User with the Services, and includes the User’s name, personal health number, date of birth, address, email address and other contact information, account security information such as password and security questions, User financial information such as credit card, debit card, financial institution and bank account information, and the User’s acceptance of these Terms of Use.
